1. Acceptance of Terms

By accessing or using BIKE SPEZL (the "Platform"), operated by theBrandBakery.llc ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Platform.

3. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not use the Platform to:

• Violate any applicable federal, state, or local laws or regulations.
• Transmit any unauthorized advertising, spam, or unsolicited communications.
• Attempt to gain unauthorized access to any part of the Platform or its related systems.
• Reproduce, duplicate, copy, sell, or exploit any portion of the Platform without express written consent.

4. Accounts & Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions & Payments

Some features of the Platform require a paid subscription. All payments are processed securely by Stripe, Inc. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time; cancellations take effect at the end of the current billing period. We reserve the right to modify pricing with reasonable notice.

6. Intellectual Property

All content, design, software, and materials on the Platform are the property of theBrandBakery.llc / Laurin Luis Kamm and are protected under United States copyright law (Title 17, U.S. Code) and other applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes only.

7. User Content & Image Rights (Haftungsausschluss)

You are solely responsible for all data, files and pictures you upload, create, share or publish on the Platform ("User Content"), including geometries, builds, kinematic designs, part data, side-view pictures, part pictures, forum posts and spare-part listings.

By uploading a picture or other material you declare that you own it or hold all rights and permissions necessary to upload it and to make it available on the Platform — including publishing it to the Crowd or Cloud galleries, sharing it with other users and showing it to subscribers behind a login or paywall — and that it does not infringe copyrights, trademarks, design rights, personality rights or other rights of third parties.

Every entry and picture on the Platform is linked to the account that created or uploaded it. You grant theBrandBakery.llc a non-exclusive, worldwide, royalty-free licence to store, reproduce, process and display your User Content to operate and provide the Platform, for as long as it remains on the Platform. You indemnify theBrandBakery.llc against all third-party claims, costs and damages arising from User Content you uploaded, unless you are not responsible for the infringement.

We do not review User Content before it is published and are not liable for it. If you believe content on the Platform infringes your rights, contact us (section 13); we will remove or block access to unlawful content promptly once we become aware of it, and may suspend accounts that repeatedly infringe. Uploading pictures is available on paid plans and to verified brands; profile pictures are available to every user.

8. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, theBrandBakery.llc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.

11. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy. We collect and use personal data only as necessary to provide the service, including account management and payment processing. 12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Platform after any changes constitutes your acceptance of the new Terms.
